L’articolo analizza in chiave critica la disciplina nazionale del subappalto nell’ambito delle gare pubbliche, così come recentemente riformata a seguito di diversi interventi normativi in ottemperanza alla procedura d’infrazione avviata dalla Commissione UE. The article critically analyzes the Italian regulation of subcontracting in the context of public tenders as recently amended by several legislative measures in compliance with the infringement procedure launched by the European Commission against Italy. According to the Author’s view the current legislative framework – characterized by the almost overall elimination of the previous limits (probably even going beyond what the European Commission requested) – lacks in finding a fair balance between the principle of the maximum participation in the tender on the one hand and the need to prevent and reveal potential collusive conduct on the other. Furthermore this conclusion is supported by the analysis of the regulation of the causes of exclusion from the tender still too timid in envisaging the optional exclusion of the participants due to anticompetitive conduct.

The contribution critically and from a geographical perspective discusses the connection between propaganda comics and cartoons in the period of twentieth-century totalitarianisms. The way in which space real and symbolic is implicated through the rhetoric and dialectics of power in social economic and identity dynamics is then explored. In order to study some aspects of the pilgrimage to Santiago de Compostela from the point of view of cultural geography in Spain the chapter takes into consideration a literary text the autobiographical novel "The pilgrims' ballad" by the French writer Edith De La Héronnière first published in 1993 and translated into Italian in 2004. The novel recounts the experience of the Jacobean pilgrimage carried out by the author in the nineties together with three traveling companions starting from a French journey. In particular through the analysis of some parts of the text the ways in which the narration constructs and describes the physical and symbolic space of the pilgrimage are investigated. In this way it is possible to explore the way in which peculiar attributions of meaning inscribe the experience of pilgrimage in a symbolic universe that is both personal and collective at the same time.

The definition "Franco-Caribbean Literature" used by convention from the critique to indicate all the literary production in French of the central region of the American continent is very improper. The Caribbean region includes in fact the islands of Martinique Guadeloupe Haïti and the Guiana. Despite the diversity of ideological movements and historical events that took place in these countries the literary works of the Caribbean writers have fluctuated and continue to oscillate between two tendencies: that of rooting in tradition and that of escape from it. The writers show themselves open to comparison and dialogue with other literary and cultural traditions in order to create a narrative form that corresponds to the many inheritances of those composite populations. Here the cultural syncretism that has been created allows to recognize a common identity in the name of all that the West wanted to extinguish. La tutela del lavoro nell’impresa sequestrata o confiscata tra contratto e mercato

Il saggio esamina il sistema delle regole che ineriscono la gestione della forza lavoro nell’impresa sequestrata o confiscata per metterne in luci pregi e criticità. La ricerca mette in particolare in luce i limiti della tesi che fa leva sulla prevalenza della disciplina contenuta nell’art. 56 del d.lgs. n. 159/2011 sulle regole generali. Il tema è indagato attraverso materiale giurisprudenziale in parte inedito e una valutazione critica del ruolo del sindacato.

l contributo analizza l’impatto che il recente inserimento dell’ambiente in Costituzione può dispiegare in ambito penale, tanto rispetto all’ambiente quale oggetto della tutela penale, quanto sul versante della selezione dei modelli di illecito, soffermandosi in particolare sul problema delle possibili ricadute penalistiche del nuovo vincolo di solidarietà ecologica di tipo intergenerazionale. Seguendo il fil rouge del bene giuridico, la seconda parte del saggio ricostruisce invece i punti critici e le prospettive di sviluppo del diritto penale ambientale internazionale, alla luce della nozione di ambiente quale bene giuridico comune ed universale.

The paper analyses the impact that the recent inclusion of the environment in the Italian Constitution may have in the criminal law both with respect to the criminally relevant notion of the environment and with regard to the selection of the types of criminal offences. From this point of view the paper also takes into consideration the penal significance of the new bond of intergenerational ecological solidarity. The paper presents the study of the plaster formulated to imitate the natural stones and marbles that are popular in Sicily in the early twentieth century and points out that the first applications and the dissemination of new mortars also in the rest of Italy feels the influence of the experiments conducted throughout Europe . The contribution summarizes the results of a rigorous and thorough reconnaissance of patents kept in the Archivio Centrale dello Stato in Rome relating to mortars for plastering an artificial stone critically analyzes the content and emphasizes cultural contacts with the experiments on large-scale restoration projects in Italy and France in the late nineteenth century. The projects prepared for "Palermo South-East" are the result of a Graduate Laboratory structured through meetings seminars specialist communications critical exhibitions which - in a shared strategy - saw each student elaborate their work in comparison with others actors of the same Laboratory. The research on "urban projects" was set so that each graduating student was made aware of the projects carried out in the same geographical area by the colleagues who had preceded it so as to be able to operate in continuity and contribute to formulating a unitary reasoning in which each project constituted continuation verification or even variant of the previous ones. These coordinated works have pursued two fundamental objectives: the strengthening of infrastructures and the establishment of specialized public buildings with superior functions aimed at requalifying and regenerating various critical situations with particular attention to the relationship between context and life scenarios. Thus each designer while dealing with a main functional program simultaneously deals with various issues such as the rationalization of the road system the redevelopment of existing buildings the design and refunctionalization of urban services (for example the transformed Central Station in the hotel or the project of a great Mosque)several degree theses have addressed as the main theme or as a question in the background the design of a new bed for the Oreto river and the relative establishment of a park facing it. In this desire to "patch up the wounds" in the different areas of "Palermo South-East" in close relationship with the vicissitudes of the place there is a continuous reference to architectures of all time and some questions involving the functional program are suggested - that identifies the character (or perhaps "type") of what is to be inserted in a given context - and the qualities of living reality as a pivotal material in the design process.Settore ICAR/14 - Composizione Architettonica E Urbana
