The article explores the role that private autonomy is assuming within the different family models. The growing role of autonomy is governed by the general clause of public policy, which applies both in purely domestic cases and in those marked by internationality. In family relationships it seems possible to distinguish between a public order of the family and a public order in the family. The article analyzes within these categories the surrogacy and the premarital contracts.

This essay focuses on a recent development in Italian family law with respect to stepchild adoption in cases involving same-sex couples. Resorting to arguments of both the continuity of the affective relationship and the best interests of the child, courts have been willing to permit adoptions in these cases under Article 44 of L. 184/1983 (“Adoption Act”), which provides for “adoption in particular cases” (“APC”). Prenuptial agreements are legal settlements by which a couple who is about to get married can establish the terms of the respective assets and economic interests during or after the dissolution of the marriage. The enforceability of such agreements, however, requires a delicate balance between the will expressed by the parties, on the one hand, and the public interest related to family, on the other. The comparison between US, English and Italian family law on that issue will clearly show that, both in common law and civil law countries, the concepts of status familiæ and private autonomy can coexist if they are observed in the light of the highest value of human dignity.
