The research focuses on analysis of a well-known fragment of Justinian’s Digesta: 50.16.130 (Ulp. 2 ad leg. Iul. et Pap.). Formerly, several scholars have raised many doubts regard to its authenticity. The author’s basic idea is that there are not solid issues in favor of the hypothesis that the fragment is not genuine. On the contrary, both the examination of the terminology, used in the fragment, and the comparison between D. 50.16.130 and other sources (in particular: D. 38.16.1 pr.; 5.3.1 e 3; Tit. Ulp. 11.2-3; 11.14) might provide interesting evidences in support of its classical content.

Auctor de locutionibus ‘dicis gratia’ ac ‘dicis causa’ in iurisperitorum lingua significationem inuestigat. Haec uocabula forsitan propria iurisconsultorum ueteris sermonis sunt (arg. ex Varro de ling. Lat. 6.61). Non est inverisimile quod Gaius (in Gai 1.141, 1.190, 2.103-104, 2.252) illorum uerborum pristinum ualorem resonat. Moving from some perspectives of investigation emerged during the Roman law Seminar on ‘Orizzonti della critica testuale fra tradizione e nuovi indirizzi’, held in Palermo (16 november 2018), the A. examines a ‘comparison’ between texts, respectively, of Justinian’s Institutes and Digest [I. 2.11.5 = Marc. 4 inst. The author deals with the issue concerning the conferment of various grants – including the Roman citizenship, and also the right of legal marriage with foreign women, immunity from taxation for ten years, new settlers, the right to the property of citizens killed in the war – by the Emperor Claudius in favor of the inhabitants of Volubilis in Mauretania through the analysis of three well-known inscriptions which record these benefits which the community have gained from Claudius: namely, IAMLat 369, 370a, 448.

Among the problems long debated by the scholars of the Greek Paraphrase of Justinian’s Institutes, the most interesting was the one concerning the legal sources used by Theophilus; they indeed are not identical with Justinian’s Institutes. Furthermore, a point of view prevails that claims the Antecessor – during the editing of his Paraphrase – could also have taken into consideration Gaius’ Institutes. The speech is based on a close anaysis of the principal sources, that describe two periods in testamentum per aes et libram evolution’s (especially, Gai 2.102-108, PT. 2.10.1), but it also concern – more generally – the analysis of well-know passages (see, in particular, Tit. Ulp. 20.2-9; Gell., Noct. On the basis of the exegesis of certain texts in the Justinian’s Digest, namely 13.6.3.6 (Ulp. 28 ad ed.), 12.1.18.1 (Ulp. 7 disp.), 13.6.4 (Gai. 1 de verb. obl.), 46.3.67 (Marc. 13 dig.), the Author formulates some considerations on the commodatum so-called ad pompam vel ostentationem, pointing out that the applications related to that anomalous commodatum were more complex and not merely confined to the idea of exhibiting id quod usu non consumitur for ‘pomp’, id est (by doing) ‘ostentation’.
