El Ccfilip de 1949 posee igual estructura y aproximadamente un 40% de preceptos iguales del Ccesp de 1889, otro tanto modificados (en parte recogiendo jurisprudencia del TS español), y el resto procede de instituciones propias y del Derecho anglonorteamericano. The legislative worry about 'the best interest of Child' was collected in articles 10 and 39 of the Spanish Constitution (1978). These article provides that international treaties are, in general, interpretive means about human rights, and particularly, in rights granted to those child. After Spain's ratification of the 1989 Convention, the Organic Law 1/1996, about Legal Protection of Minors (LPJM), and Law 54/2007, of International Adoption, complete the Spanish system, systematically exposed and in form of answers to the questionnaire of the presenter.
