El presente trabajo plantea que la doctrina del control de convencionalidad se enmarca dentro del no positivismo jurídico. En tal sentido, analiza críticamente las tensiones que genera con elementos centrales del funcionamiento de los sistemas jurídicos herederos del Derecho positivo-legislado. This paper presents that the doctrine of conventionality control is part of non legal positivism. In this sense, critically analyze the tensions generated by central elements of the functioning of the legal heirs of positive law systems - legislated.
