In sentence 215/2019 of April 5th, the Supreme Court establishes its criteria on the exercise of guardianship and joint custody of minor children and common housing in cases of economic incapacity of the parents. Along these lines, an analysis of the pronouncement is made and different conclusions are drawn about different figures in Spanish Family Law.

In this study, different views on the legal situation of incapable and disabled people are analysed according to normative, doctrinal and jurisprudential criteria. An examination of the problem regarding the validity and effectiveness of their legal acts and businesses is also made, making a brief reference to the main novelties of the Draft Law on Civil and Procedural Reform on Disability.

El consentimiento informado es una de las principales garantías de la libertad del individuo en el ámbito médico. El propio paciente tiene la capacidad de decidir sobre sus tratamientos médicos o sus operaciones quirúrgicas. Sin embargo, esta autonomía de la voluntad puede generar situaciones de conflicto, especialmente en casos con pacientes menores de edad. Informed consent is one of the main guarantees of the individual’s freedom in the medical field. The patient has the ability to decide on his medical treatments or his surgical operations. However, this autonomy can generate situations of conflict, especially regarding patients under age.
