La jurisdicción especial indígena en el sistema jurídico colombiano

El presente artículo abordar la jurisdicción especial indígena prevista en la Constitución Política Colombiana de 1991. Para ello, se sostiene que dicha institución debe contextualizarse en la propuesta normativa del multiculturalismo contemporáneo, que responde a un devenir histórico particular y que ha sido desarrollada, en ausencia del legislador colombiano por el juez constitucional hasta delimitar los elementos que actualmente componen el “fuero indígena”. This paper address the special indigenous jurisdiction under the Colombian Constitution of 1991. For this purpose, it argues that the institution must be contextualized in the normative proposal of the contemporary multiculturalism, which respond to a particular historical development and has been developed in the absence Colombian legislative brach by the constitutional court to define the elements that currently make up the “indigenous jurisdiction”.
