Based on a local regulation, this article explains that ethics can justify juridical paternalism. To the end that must fulfill two premises: an empirical one, which verifies a person basic incompetence; and a normative ethics as a result of coercive interference based on benevolent purposes, by all means, that encourages autonomy by overcoming an inequality situation.
