The article addresses the so-called principle of speciality referred to in Article 607e of the Criminal Procedures Code in connection with Article 27 of the Council Framework Decision of 13 June 2002 no. 2002/584/JHA on the European arrest warrant and the surrender procedures between Member States, and the exception to that rule specified in Article 607e § 3, item 2 CPC and Article 27(3)(a) of the EAW Decision. This article also assesses the order of the Appellate Court in Gdańsk of 31 May 2016, case reference II AKzw 921/16, and the argument that the deadline of 45 days referred to in Article 607e § 3, item 2 CPC cannot start to run with respect to a Polish national. The article refers to the legal situation as of 31 May 2021
