The study points to the urgent need to introduce legislative changes in the bankruptcy law, making it easier for aggrieved creditors to pursue ex delicto compensation claims against a person who has committed a tort while acting as a trustee in bankruptcy during the bankruptcy proceedings. The possibility for an individual creditor to pursue all claims against the trustee in bankruptcy for the benefit of the entire community of creditors would improve the compensation function of Article 415 of the Civil Code and Article 160(3) of the Insolvency Law, the preventive function, and the repressive function. Such a mechanism evokes obvious associations with actio pro socio. The study presents the legislative assumptions for the proposed amendments
