El presente comentario tiene por objeto analizar la competencia judicial internacional respecto de los litigios que se originen consecuencia de la existencia de un contrato de trabajo que vincula a empresario y trabajador cuando existen elementos de internacionalidad que hacen necesario recurrir en el ámbito de la Unión Europea al nuevo Reglamento Bruselas I bis. En la segunda parte del comentario se analiza la determinación de la Ley aplicable por el juez competente en el Reglamento Roma I de obligaciones contractuales concluyendo qué aplicación práctica tiene en la actualidad el art. 1.4 del ET The present comment is intended to analyze the international jurisdiction with regard to labor disputes that produce as a result of the existence of an employment contract which linking employer and employee when there are internationality elements that make necessary to resort in the European Union scope to the new European regulation Brussels I bis.
