L’articolo analizza la Direttiva (UE) 2017/1371 in materia di tutela penale degli interessi finanziari UE, mettendola a confronto sia con la Convenzione PIF del 1995 e i suoi Protocolli del 1996 e 1997 sia con la Proposta di Direttiva 2012/363 della Commissione UE. Dal confronto emerge, in particolare, come la Direttiva, se costituisce un notevole progresso rispetto al sistema convenzionale pre-vigente, finisce invece per deludere le attese create dalla ben più coraggiosa proposta della Commissione. The article analyses the Directive (EU) 2017/1371 concerning the protection of EU financial interests by means of criminal law, comparing it both with the 1995 EU Convention and its Protocols, on the one hand, and with the Directive proposal No. 2012/363 presented by the EU Commission, on the other hand. What comes up from this comparison is that, while the Directive represents an important improvement with respect to the pre- existing Conventional system, it does not meet the expectations raised by the courageous proposal of the Commission.
