La jurisprudencia del TS está contribuyendo con su doctrina a adecuar la pensión compensatoria a las necesidades actuales estableciendo los siguientes criterios: 1º) la pensión no es un medio de igualación entre los patrimonios de los cónyuges; 2º) la percepción de una herencia es un motivo sobrevenido que permite entender que han aparecido circunstancias que han modificado sustancialmente la situación económica; y 3º) vivir maritalmente requiere una convivencia estable, con vocación de continuidad y permanencia. The case law of the Supreme Court has established the following criteria about compensatory pension: 1º) the pension is not a means of matching between the assets of the spouses; 2º) receiving an inheritance is a supervening cause that allows understanding that have appeared circumstances that have altered the economic situation; and 3º) marital life requires a stable cohabitation with vocation of continuity and permanence.
