RESUMENEsta comunicación analiza porqué no existe en nuestro ordenamiento ningún derecho a la maternidad o derecho a la paternidad, y cómo cuesta llegar a un consenso sobre si nuestro ordenamiento jurídico protege los derechos sexuales y reproductivos, y si lo hace, cuál es el contenido de estos derechos. Este análisis se contrasta con el debate doctrinal que si se ha producido sobre la existencia de un hipotético derecho a la reproducción, una autonomía procreativa en positivo, y la correspondiente discusión sobre su respaldo en nuestro actual ordenamiento jurídico. Debate que no se aplica en los mismos términos cuando se trata de la autonomía reproductiva en negativo, por ejemplo, en el caso del aborto. ABSTRACT This paper examines why there is not any right to maternity or paternity in our legal system and how difficult is to reach a consensus on whether our legal system protects sexual and reproductive rights, and if so, which is the content of these rights. This analysis is contrasted with the debate which has taken place about the existence of a hypothetical right to a positive procreative autonomy, and the corresponding debate on its legitimacy and justification in our current legal system. However this debate does not apply in the same terms when it comes to negative reproductive autonomy, for example, in the case of the abortion
