La Sentencia comentada concede la custodia compartida a un progenitor no custodio que había solicitado la modificación de las medidas de divorcio, atendiendo a la edad del menor cuando se firmó el convenio y a la flexibilidad por los progenitores del sistema inicialmente pactado. El Tribunal Supremo resalta el efecto irreversible del tiempo en el desarrollo del menor como cambio cierto y la necesidad de evitar petrificar la situación del hijo.
