Prevaricato y nulidad de laudos: un comentario al proyecto de ley de Bolivia

En Bolivia, está en proceso de modificación la Ley 1770, de Conciliación y Arbitraje. La ley proyectada incluye una nueva causal para la anulación de laudos. Se trata de la anulación del laudo si el mismo es dictado en prevaricato. El artículo examina esta causal y concluye que la misma es redundante, perjudicial e inconstitucional Bolivia is going to amend its current law on conciliation and arbitration (Law 1770). The projected law includes a new ground to nullify an award. It is the nullification of the award if it was pronounced on prevarication. The article analyses this ground and concludes that it is redundant, harmful and unconstitutional
