En la Convención sobre los Derechos del Niño, el concepto del interés superior es uno de sus principios rectores. Para relacionarlo con la vida real, y las diferentes formas de entender este principio, nos centramos en la evaluación y determinación del interés superior del niño en el contexto de una crisis matrimonial, así como en el análisis de los criterios adoptados por la doctrina de la Sala de lo Civil del Tribunal Supremo en recientes sentencias sobre el ejercicio de la corresponsabilidad parental y otras medidas a adoptar tras la ruptura de la convivencia At the Rights of Child´s Convention the main topic is the best interest as the guiding principle. Relating to the real life, and the different ways to understand this principle, we are focus on the evaluation and determination of the best interest of the child in the context of a marital crisis, also concerned in the criteria adopted by the doctrine of Civil Chamber of the Supreme Court in accordance with the recent judgments on the exercise of the parental co-responsibility and other measures to be adopted after the breaking off family life.
