El presente trabajo examina la configuración general del derecho a la propia imagen y sus mecanismos de protección. Posteriormente se estudia la imagen como objeto material en el derecho penal, pues por razones de política criminal se ha descartado que el derecho a la propia imagen sea un bien jurídico autónomo penalmente protegido. This paper examines the general configuration of the right to one’s own image and its protection mechanisms. Subsequently, the image is studied as a mere object in criminal law, since for reasons of criminal policy the right to one’s image has been ruled out as legal interest in the criminal order.
