Il lavoro prende in esame i problemi che l’art. 230-ter c.c., introdotto dall’art. 1, co. 46, l. n. 76/2016, solleva all’interprete, chiamato ad individuare la ragione per la quale il legislatore ha preferito riconoscere al convivente soltanto parte dei diritti attribuiti dall’art. 230-bis c.c. al coniuge e dei quali beneficia ora anche la parte dell’unione civile. The essay examines the problems that the art. 230-ter c.c., introduced by the art. 1, co. 46, l. n. 76/2016, lifts to the interpreter. He’s called to individualize the reason for which the legislator has preferred to recognize to the cohabitant only some rights attributed by the art. 230 bis c.c. to the consort and of which profits also now the part of the civil union.
