Co-operatives and labour societies are the most important organisations within the framework of Social Economy. The establishment of these societies, which create employment in the private sector with a democratic philosophy based on mutual help, has been recently boosted thanks to the support of public power. Their growing importance can be explained by three factors: the Employment Policy, the Social Policy and the productive decentralisation. As far as labour is concerned, these societies offer the following advantages: intensive use of labour, high rate of stability in employment, high levels of productivity, training and surplus re-inversion, lower rate of inflation, fewer conflicts than in other economic sectors and, finally, an avant-garde position as far as the fight against social exclusion is concerned. This paper analyses the problems posed by such enterprises as far as the “Derecho del Trabajo y de la Seguridad Social” (Labour and Social Security Law) is concerned. To this end, two models are analysed which display important differences, since those working in co-operatives cannot be compared with wage earners, unlike those working in subordinate services in labour societies. The main issues studied by our paper are the duality of professional regulations, the logic behind such an approach and its critical review.
