In Italy the discussion about the access to artificial procreation and adoption by parents omosex is very strong in the last years. Many sentences by Corte Cassazione and Corte Costituzionale invite the Parliament to discuss a new law to improve the protection of children born with PMA abroad and to remove discrimination among children. In this paper there are the last solutions find by the italian superior Courts in the silence of Parliament.
