Per dare una risposta ai principali problemi che pone all’interprete la remissione del debito, occorre individuare gli interessi del creditore e del debitore ad essa sottesi. La determinazione della causa che caratterizza la remissione permette di accertare, da un lato, se essa costituisca l’unico schema di rinuncia relativo ai diritti di credito, e, dall’altro, se la struttura della remissione sia sempre la stessa oppure muti a seconda degli interessi concreti del determinato rapporto obbligatorio preso in esame. It’s necessary to individualize the affairs of the creditor and the debtor to give an answer to the principal problems that the remission of the debt sets to the interpreter. The determination of the cause that characterizes the remission allows to verify, from a side, if it constitutes the only scheme of renouncement of rights of credit, and, from the other, if the structure of the remission is always the same or mute one according to the concrete affairs of the determined obligatory relationship taken in examination.
