The Central Mediterranean Route: Law Enforcement Without the Rule of Law
2017
It could be successfully argued that there is a general obligation to save lives in danger at sea and that this obligation is moral in nature. Such reasoning, however, is not the specific aim of this paper. Instead, this paper focuses on the legal obligations of the European Union (EU), its Member States, other neighbouring countries, and the EU Border and Coast Guard, towards migrants attempting the risky journey to Europe, in order to find out whether there are any legal steps that can be taken in order to help eliminate deaths in the Mediterranean. The article focuses on the main International Conventions on maritime law, international human rights law, international asylum law, the rele…
Women on the Run: Human Suffering and Empowerment during Their Travel Towards Italy
2021
In Italy, in recent years, the attention to female in migration has been linked to the increase in the number of women who emigrate alone to look for work like men. Women who become breadwinners, provide economic resources for the needs of their families; women who give rise to chain migration, and also family reunions, in which husbands are reunited, to reach them. Women engaged in jobs that have an importance for the functioning of the receiving society, but also women who are present as refugees and asylum seekers, women on the increase in trafficking in human beings and trafficking for sexual exploitation. Women have always emigrated, but today in the Mediterranean countries they are in…
Asylum Reforms, Discrimination of Refugees with Special Needs and Practices of Resistance in Local Contexts of Europe
2019
The standardization of the asylum system demonstrated a gap in providing specific assistance to asylum seekers with specific vulnerabilities as required in the Art. 17 of the 2013/33/EU Directive. The aim of this proposal is to describe the results of the research "Provide", founded by the EU (Rights, Equality and Citizenship Program 2014-2020), conducted in the last two years . The reasearch, based on mixed methods, highlights a problem of legislative discomfort between the EU and the different States; a gap in the assistance of migrants with specific needs; a problem of lack of understanding of phenomenon of proximity violence. In France, it is highlighted a lack of porosity between the C…

Refugees’ perception of their new life in Germany
2021
Since 2015, Germany has been hosting noticeable incoming flows of refugees and asylum seekers and despite the quality of life of refugees is expected to be improved in the aftermath of their arrival to Germany, refugees are still facing several problems of integration and economic deprivation. Using a sample of individuals from the first wave of the German IAB-BAMF-SOEP Survey of Refugees, we present some preliminary analyses on their life satisfaction (LS). A gamma glm was estimated to focus on the association among levels of LS and main socio-demographic characteristics as well as post-migration factors. Greater stability (both in the legal and personal sphere) in refugees’ lives is posit…

El impacto del cambio climático en la movilidad humana : las migraciones climáticas en el contexto internacional y europeo
2021
For decades, the migration phenomenon has been one of the thorniest regulatory issues in the European Union (EU) policy. In addition, today, the fight against climate change in all regions of the world makes the situation worse for the new ?climate refugees? or ?environmental displaced people?, whose legal status is not yet covered by the ancient 1951 Refugee Convention.
The aporia of the European myth. How LGBTI+ migrants are stranded in the Italian reception system
2021
