The well known judgment of the German Constitutional Court in the “Weiss” case has been widely criticized under EU law, mainly because of its being in contrast with a preliminary ruling rendered by the European Court of Justice in 2018. At variance with these criticisms, it is here submitted that such a judgment brings well into focus some institutional ambiguities of the Economic and Monetary Union (EMU); namely, the powers (more and more) exercised by the European Central Bank (ECB) in the field of macroeconomic regulation and control, in spite of (its) not being provided with political legitimacy. The paper discusses various criticisms that are frequently leveled against the so-called “age of rights” – i.e., the contemporary legal and political doctrine that places funda-mental rights at the center of legal and political discourse, and that shapes legal institu-tions accordingly (written, rigid constitution, judicial review of legislation, etc.). After providing a definition of the main features of the age of rights, the author discusses and tries to rebut the principal critical stances on this topic, mainly by making use of the theoretical tools deployed by contemporary analytical jurisprudence on legal rights and legal reasoning.

In this article I try to show some problems of the interpretation of civil disobedience as a practice that aims to maintain democratic principles against discriminative legal patterns or oligarchic forces. I will present two doctrines, the Rawlsian (followed by Habermas) and the one proposed recently by supporters of a radical constitutional change through the exercise of “constituent power”. The Rawlsian account a) offers a too stringent model of justification of this type of practice and b) does not recognize the plurality of subjects to which civil disobedience appeal. The supporters of radical constitutional change fall into a form of heterogony of ends. They reject liberal accounts of …
