Is Martha Nussbaum really political liberal?

This paper puts under scrutiny Martha Nussbaum’s turn to political liberalism. Unlike Rawls, she seems to assume that overlapping consensus works even within societies without democratic constitutions. Though, this sort of consensus is doomed to be unstable, since there is not a previous constitutional consensus, as Rawls requires. Unlike Rawls’ constructivist theory, her conception of political liberalism is more akin to forms of moral objectivism. Moreover, her allegation of gender discrimination towards institutions that let only men run for certain jobs (such as presidency of certain catholic universities) is based on a clear cut distinction between public and private sphere. Il saggio prende in esame la teoria del diritto costituzionalista di Luigi Ferrajoli. Nel criticare le teorie del diritto anglosassoni, che vanno oggi per la maggiore, l'autore sottolinea l'utilità di una teoria pragmatica del diritto che sia adeguata all'esperienza giuridica del mondo latino. Una teoria che stabilisca una certa connessione tra diritto e morale e riconosca il ruolo che nel diritto hanno i principi, da sottoporre a bilanciamento, oltre alle regole. Il ruolo dei principi rende manifesto che nel diritto sono importanti non soltanto i riferimenti all'autorità, ma anche ai valori morali.

Per una ricostruzione del concetto di bioetica

By means of a critical investigation of the concept of bioethics starting from Potter’s work, the present essay intends to highlight aporias and paradoxes in the dominant construction in the literature of the sector. The line of argumentation aims to point out that the current concept of bioethics is not able to meet the regulatory expectations that have arisen around it. In the pars construens of the essay I will try to trace the way for a reconstruction of the concept of bioethics, bringing it closer to the origins of Fritz Jahr’s speculation and to the traditional notion of ethics, intended as a reflective science rather than a pragmatic discipline.

Fundamental rights and the proportionality principle

The paper assesses the widespread use of the test of proportionality in fundamental rights adjudication. While constitutional and human rights courts all over the world appear to be consistently engaged in deploying the test of proportionality in order to assess the permissibility of a given rights limitation, this approach is under severe criticism insofar as it is considered an attack to the very idea of fundamental rights. In this paper, we raise a few questions for Bartosz Brozek, Monica Bucciarelli and Philip Johnson-Laird. The questions we ask to Bucciarelli and Johnson-Laird concern the nature of the “sense of correctness” which is at the heart of our normative judgments and reasoning, and the status of the laws of logic relating to mental models. Our questions to Brozek concern the distinction he traces between rudimentary and abstract rules, the role of language in normative behaviour, and the role of mental simulation in the understanding of abstract rules.

In this paper, after offering a short vindication of public health as public good that liberal government should guarantee, I will show why Ronald Dworkin’s theory of justice in health care does not offer guidance in two cases that arise in pandemics: 1) how to set priorities in rationing access to intense care unit, 2) how to choose between vaccination policies. This lack of guidance is due to an unrealistic assumption that follows from Dworkin’s idea of the unity of value: that it is always possible to strike a balance between individual rights and collective claims in maintaining a public good (in this case public health).
