Abstract The aim of this paper is to introduce some elements of a research project in legal philosophy. Its goal is to identify some crucial topics for the definition of law. In the first part (§§ 1 & 2) I analyse some methodological difficulties of the dominant research on the definition of law. In the second part (§§ 3 & 4) I refer to some current development of law and sketch some characteristics of the object to be defined, corresponding to what can be called the process of law differentiation. This chapter seeks to explain and evaluate Shapiro’s theory of legal interpretation, as it is outlined in his recent book ‘Legality’. More specifically, in the following I will try to provide (a) a reconstruction of Shapiro’s theory of legal interpretation, as it is developed in ‘Legality’; (b) an assessment of this theory of interpretation on its own terms (i.e. its internal coherence, its overall persuasiveness); and (c) an evaluation of the compatibility of this theory of legal interpretation with the general project of ‘law as plan’.

In his latest book Massimo La Torre makes a number of criticisms to legal positivism. Most of them are convincing. In this essay I try to reply to the few I disagree with. In particular, I deal with La Torre’s objections against Hart’s theories on legal interpretation and the internal point of view and against Raz’s theory of legitimate authority. In the last paragraph I outline some ideological reasons for not considering legal positivism entirely dead.
