Polish local democracy in crisis? Non-competitive elections and the supply of candidates for councillors

Competitive elections are the basis of democracy; without them there is no freedom of choice. Elections without competition are associated with the façade nature of elections in undemocratic systems. There are, however, exceptions to the belief that in a democratic system every election must be competitive. We can also observe them in Poland, particularly in small communes with up to 20,000 inhabitants. They take two forms: non-competitive elections of commune leaders and councillors. In Portugal and in its former colonies, the expression "constitucionalismo outorgado » is part of the constitutional vocabulary since the granting of the Charter of 1826. The French inspiration is obvious ; however, no equivalent expression exists in France. This curiosity leads to measure all the ambiguity of the concept of "granted constitutionalism", an improbable oxymoron according to the president of the Portuguese Republic, Teófilo Braga. Is it about a simple political and linguistic claim, a temporary compromise at the end of a frustrated Revolution? Or does it translate a deeper program, to reconcile both sides of the constitutionalism, ancient and modern ?

The study undertakes the conclusions of partnership agreements between the cities of the Opole voivodeship and the German cities. It presents the number of partnerships, their geographical structure and the periodization of signing contracts. The main factors that contribute to the development of that form of cooperation, as well as the obstacles on the way are discussed. The paper uses a panel of more than 1m German firms over 2010-2016, to provide the first firm-bank level evidence of local crowding out for a developed economy characterized by low interest rates and fiscal austerity. Our mechanism relies on two structural features of Germany's banking landscape: the local segmentation of credit markets for small and medium-sized firms (SME) and the role of local public banks in local public finance. This paper explores how discretionary fiscal policies on the revenue side of the government budget have reacted to economic fluctuations in European Union countries. For this purpose, it uses data on legislated revenue changes and structural indicators provided twice per year by National Central Banks of European Union countries in the ESCB framework for analysing fiscal policy. The analysis is based on the estimation of fiscal policy rules linking these measures of legislated fiscal policy changes to the output gap and other control variables. This essay analyses the use of the “delegification” powers of Italian Government during the economic and financial crisis. “Delegification” regulations are often approved in Italian legal system in order to make easier the legislation and to abolish useless statutes. During the years of the economic crisis, furthermore in XVI and in XVII legislatures, “delegification” orders were considered as strategic instruments of economic and legal simplification. Nevertheless, in some cases, they added complexity to the economic and legal system.
