Nel contributo in oggetto l'autore, muovendo dalla decisione delle Sezioni Unite della Cassazione n. 61 del 7 gennaio 2014, coglie l'occasione per riesaminare le vecchie e nuove problematiche sottese all’intervento dei creditori nel processo esecutivo. It concludes however that a revolution like the aforesaid explained would be only apparently advantageouOld and new problems related to the intervention of creditors in the expropriation (marginal notes at Cass. January 7 2014 n. 61) Moving from the decision of the Sezioni Unite n. 61/2014 the author takes the opportunity to re-examine old and new problems related to the intervention of creditors in the forceable execution. The first major theme concerns par condicio creditorum which is examined in its evolutionary history since the Code Napoleon through its period of maximum extension (the Code of 1940) until its reduction as a result of the reforms of 2005. The author examines the possibility to overcome quoad effectum the distinction between sine titulo et cum titulo interveners in light of jurisprudence’s evolution between 1978 2009 and 2014. The possibility in particular concerns those creditors sine titulo the where credit has not been contested (ex art. 499 c.p.c.) by the debtor seek payment and partecipate to distribution. In the last section the author examines the possibilities for other creditors to contest the intervention of the creditor sine titulo ex art. 499 c.p.c. (utendo iuribus in subrogation in case of inaction of the debtor) or in the distribution phase ex art. 512 c.p.c. He concludes that the only person that will be really damaged if he doesn’t contest - ex art. 499 c.p.c. - the credit it is precisely the debtor. The monophyly and evolution of Cynara L. (Asteraceae) sensu lato: evidence from the Internal Transcribed Spacer region of nrDNA

The monophyly and evolution of Cynara was investigated using ITS sequence data. Parsimony analysis supports the monophyly of Cynara sensu lato, i.e. including the distinctive taxa C. humilis and C. tournefortii. This contradicts the recent decision to create a new monotypic genus Arcyna for C. tournefortii. A hypothesised close relationship between C. tournefortii and Silybum Adans. is also refuted. Four of the five species of Cynara, for which multiple accessions were sequenced, were shown to be monophyletic but C. baetica was found to be non-monophyletic. Hybridization and competition between the endangered sea marigold (Calendula maritima, Asteraceae) and a more common congener

Occurrences of hybridization between the rare, endangered Sicilian endemic, Calendula maritima, and other congeners in the wild have been suspected by several authors, but never demonstrated. In San Cusumano (Trapani), one of the only three Sicilian mainland populations, C. maritima occurs in close proximity to the more common congener C. suffruticosa subsp. fulgida, and individuals morphologically intermediate between the two taxa have been observed. These are two ways of approaching the consumption of sports by spectators and actorIn the last thirty years sport has taken on a very significant meaning in people's lives and albeit with considerable differences both in advanced economic development countries and in developing countries. On an individual level it constituted an area of identity investment when it assumed the shape of “sport spectacle” to be enjoyed fueling the practice of cheering and fandom or constituting the model of a winning lifestyleand the two ways of use can be strongly related to the perception and assessment of the quality of life. The “semantic universes” which however connote sport and “free time sports” have often appeared polarized. Commercial sport and sports professionalism are intertwined with the institutions of economics politics and culture which above all stress its “spectacularity” in order to capture first and foremost the audience. But also the sport of leisure time is intertwined with the actions of the institutions of economics politics and culture with the difference that these stress above all its “healthy value” aimed at the “healthy and rational” investment of time in an activity which improves the quality of life in the short medium and long period. This polarization between the consumption of sport entertainment - commercial sport - and the consumption of sport as a leisure activity - sport for all - has become increasingly interconnected precisely because of the increased collective identity demand via sport. In other words we have witnessed the spread of shape of sports entertainment that recall the importance of sports for psychophysical well-being for integration and social participation for the reduction of social inequalities ethnic and cultural differences and in which the importance assumed was weakened in the show from agonism from competition from the physical confrontation between two contenders or two teams. A sport in which we act with competitors as well as against competitors. And on the other hand we have gradually witnessed the spectacularization of sports in our free time to the point that the sharing of the results obtained through the declination of a competitive spirit that presents itself as directed no longer against other contenders but against its own performance limits it has become the way in which each person makes part of his or her own life spectacular the one he often considers most authentic.
