2022

International Cooperation in Criminal Matters between Spain and Latin America

2006

ABSTRACTFor some years now, Spain has been in the vanguard of the court battle against international crime, particularly since the Pinochet case. The country’s progressive legislation about universal justice and the interpretation of such principle by the Spanish Constitutional Tribunal in the Guatemalan case (and later, in the Falung Gong case) are the reasons behind its exceptional role in the application of International Criminal Law. However, the exercise of this right entitled to the victims, when directed against the citizens of one of the permanent U. N. Security Council country members, has precipitated a legal reform in the end. It is undeniable that these States, and particularly …

Agreements regarding the property relations of transnational couples and their effects under the application of the twin regulations

2021

It is a true and verifiable fact that the family institution has evolved over recent decades in Europe and throughout the world, but not uniformly or at the same time. This is because it is influenced by social and cultural connotations specific to each State. All of which are respected under EU Regulations 2016/1103 and 2016/1104. Właściwość sądów w sprawach karnych w Polsce w latach 1928-1939

2013

The Code of Criminal Procedure of 1928 provided three types of jurisdiction: material, topical and functional. In general, legal solutions adopted in the Code including provisions on material jurisdiction should be viewed positively. The regulations covered all the cases the Polish courts could hypothetically come across in practice, procedurally solving many issues connected with it. The most important cases included: the invalidity of judgments issued by the improper court, the jurisdiction of the magistrates courts, the determination of the topical jurisdiction of the courts, the aggregate consideration of cases, and resolving conflicts of jurisdiction between common and military courts.…

M.N. e altri c. Belgio: qualche osservazione dissenziente

2021

In this commentary to the M.N. v. Belgium case, the authors criticize the three fundamental arguments on which the decision of the European Court of Human Rights is founded: the approach based on ‘originalism’, the approach based on the Courts’ precedents, and the approach based on consequentialism. As far as consequentialism is concerned, the authors approve the use of non strictly legal arguments in the Court’s reasoning, convinced as they are that human rights courts, more than any other judge, are not la bouche de la loi, but hold political power. We criticize the Court's choice to give space to only one of the (possible) political consequences of its decision, completely disregarding a…

La suprema giurisdizione nella Sardegna moderna. Travagli della Real Audiencia (1564-1651)

2019

The institution of the Real Audiencia in the kingdom of Sardinia since the 1560s is part of a wider process which saw the rise and development of royal supreme courts of justice in several European countries of the early modern period. In fact, major State formation processes all around Europe required that monarchs increased their control on local authorities and that new increasingly centralised systems of judicial review gained precedence over all particular jurisdictions, feudal as well as municipal. This brought about a dramatic transformation in the field of criminal law enforcement and administration of justice.

Jurisdiction in cases of divorce, legal separation or marriage annulment

2021

The subject of coordination is fundamental for the functioning of jurisdictional rules of the Regulation n.2016/1103 on matrimonial property regimes and Regulation n.2016/1104 on the property consequences of registered partnerships. Both Property Regimes Regulations have the purpose of gathering litigation before the courts of one Member State and have the related procedures managed by the courts of the same Member State.

Party autonomy regarding jurisdiction under the property regimes regulations

2021

The main accomplishment of the Property Regimes Regulations lies in their bringing more coherence into the cross-border family law adjudication.
