LA RESPONSABILITÀ DIRIGENZIALE QUALE RESPONSABILITÀ “CONTRATTUALE DI DIRITTO PUBBLICO”
2020
The purpose of the essay is to reconstruct managerial liability in terms of "contractual liability of public law". The first part of the text outlines the origins, the essential characteristics, the foundation and the constitutional importance of managerial responsibility, while the second part analyses in…

2011
The authors focus on the liability of the surgery team members in the case they inadvertently forget behind in the patient's body a foreign abject, which causes injuries and/or death. The authors underline that, according to the current case law regarding medical malproactice, both the main surgeon and their assistant/subordinate are liable for engaging in a markedly imprudent and/or negligent conduct, such as not double-checking scrupulously the surgical site before its closure in order to highlight forgotten foreign bodies. As well, the authors underline that either the circulator nurse or the theatre nurse can be considered punishable by law when that medical error occurs, even if they a…
Another "French paradox": explaining why interest rates to microenterprises dit not increase with the change in French usury legislation
2015
Conventional wisdom indicates that the growth of credit may not materialize if credit rates remain capped by usury laws, as had long been the case in France. France therefore abolished usury ceilings on loans to microenterprise in an effort to increase financing for microentrepreneurs. This should have led to an increase in interest rates and increase in microcredit. However, we do not find any increase in interest rates and this is therefore a paradox. The paper provides a brief literature review and the salient features of the legislative changes in France. It follows this up with a presentation of interest rate movements. The discussion of possible explanations of the paradox includes cl…
Asset and Liability Management for Insurance Products with Minimum Guarantees: The UK Case
2006
Abstract Modern insurance products are becoming increasingly complex, offering various guarantees, surrender options and bonus provisions. A case in point are the with-profits insurance policies offered by UK insurers. While these policies have been offered in some form for centuries, in recent years their structure and management have become substantially more involved. The products are particularly complicated due to the wide discretion they afford insurers in determining the bonuses policyholders receive. In this paper, we study the problem of an insurance firm attempting to structure the portfolio underlying its with-profits fund. The resulting optimization problem, a non-linear program…
Uzņēmuma pārejas fakts administratīvajā procesā
2022
Uzņēmuma pārejas regulējums pēc Komerclikumā ietvertās normas mērķa administratīvajā procesā tiek izmantots kopš 2019.gada. Bakalaura darba mērķis ir veikt pieejamo tiesas nolēmumu analīzi un noskaidrot vai uzņēmuma pārejas konstatācijā nepastāv būtiskas problēmas, īpašu vērību pievēršot tam, ka uzņēmuma pāreja paredz solidāru uzņēmuma nodevēja un ieguvēja atbildību. Darba autors secina, ka uzņēmuma nodevējam un uzņēmuma ieguvējam turpinot saimniecisko darbību, administratīvais akts būtu izdodams pret diviem adresātiem – uzņēmuma nodevēju un uzņēmuma ieguvēju, izvērtējot uzņēmuma pārejas faktu, ir nepieciešams nošķirt noslēgušos uzņēmuma pāreju no tādas, kas vēl tiek turpināta. Ir nepiecieš…
SOME COMPARATIVE REFLECTIONS ABOUT JUDICIAL LIABILITY
2017
The emergence of an independent judiciary and the associated and consistent implementation of the separation of powers principle are fundamental achievements of modern times and important characteristics of the transition to the rule of law. Against this background, any attempt aimed at reforming the independence, control structure or liability of the judiciary must be viewed critically, since reform efforts in this area often imply profound modifications to the deep layers of a legal and political system. The question must be settled in the light of the new phenomena of Europeanization, globalization, and internationalization. These developments inevitably subject the judiciary to new chal…
La responsabilità della capogruppo per la violazione del duty of care: note a margine di Okpabi v. Royal Dutch Shell Plc
2021
The paper examines a UK-Supreme Court of Justice decision (Okbapi v. Royal Dutch Shell Plc) concerning the liability of a parent company for the abusive con-ducts of its subsidiaries. The Court explores whether and in what circumstances the UK-domiciled parent company of a multi-national group of companies may owe a common law duty of care to individuals who allegedly suffer serious harm as a re-sult of alleged systemic health, safety and environmental failings of one of its overseas subsidiaries as the operator of a joint venture operation. Although the decision focuses on preliminary issues of summary judgment, it pro-vides inputs to a renewed reflection on the duty of care upon the paren…
OSSERVAZIONI COMPARATISTICHE SULLA JUDICIAL LIABILITY IN ALCUNI ORDINAMENTI EUROPEI
2015
In recent years, the influence of European and international laws has led to an ever-increasing pressure against the immunization and protection from liability that the judiciary has so far enjoyed. Judges liability is therefore an expression of a fundamental and world-wide change in judicial structures. Exemplary in this context is the jurisprudence of the ECJ, affirming that the EU principle of State liability can also be applied to judicial wrongs; furthermore, the European Commission has, in the past, promulgated the notion that the infringement procedure may also pertain to acts of the judiciary. The connection between public international law and liability of the judiciary becomes eve…
