Law, Plans and Practical Rartionality

2012

There is, according to many contemporary jurisprudential theories, a tight relationship between law and practical rationality: the law gives us, or at least it purports to give us, reasons for action. In his book, Legality (2011), Scott J. Shapiro puts forward what at first glance appears to be a new view in this vein. Shapiro calls it the “Planning Theory” of law; it provides an account of what the law is in terms of a particular kind of reasons: plans (a notion moulded, in his work in the philosophy of action, by Michael E. Bratman). In this paper, I provide a reconstruction of the Planning Theory as a view of the relationships between law and practical rationality, and I point to some fu…

Neil MacCormick’s Second Thoughts on Legal Reasoning and Legal Theory. A Defence of the Original View

2011

This paper offers a diachronic reconstruction of MacCormick’s theory of law and of legal argumentation; in particular, two connected points will be highlighted in which the difference between the perspective upheld in Legal Reasoning and Legal Theory and the later writings is particularly marked. The first point concerns MacCormick’s gradual break with legal positivism, and more specifically the thesis that the implicit pretension to justice of law proves legal positivism false in all its different versions. In brief, MacCormick uses the argument of the implicit pretension to justice of law against the thesis of the separability between law and morality and, accordingly, against legal posit…

L'Orchestra di Auschwitz. Inchiesta su Alma Rosé

2023

REVOLUTION AND PROGRESS IN KANTIAN REASON

2022

Immanuel Kant’s project for a critique of reason exhibits a foundation that has an avowedly not despotic profile. This is to say that the sense in which Kant speaks of reason as a faculty of principles appears to be intimately connected with the idea that ‘principle’, in a strict sense, can only be said of what does not escape the critical opinion and autonomy of thought that such a judgment necessarily involves. The strictly political form of government that is applied, according to Kant, to the authority of reason as exercise of non-despotic power affords a privileged point of view from which to reread, in not necessarily antagonistic terms, a widespread image in contemporary debate – tha…

Emozioni, sensazioni, intelletto. Riflessioni sulla problematica opposizione razionale/irrazionale

2022

The opposition between a rational and an irrational behavior or thought poses difficulties in understanding: what do we really mean by «irrational»? A behavior or a thought that adheres to emotions and does not arise from slow reflection can be considered irrational; on the other hand, can we state that emotional reactions and intuitions are «irrational»? I draw from Aristotle’s De Anima the idea of bringing emotions, sensations and intellect back to a unitary movement and placing them in a certain distinction with respect to dianoetic reason; Aristotelian’s bestowal of cognitive value on emotions was then lost, in Western gnoseology, in parallel with the devaluation of the prerogatives of …
