Frazionamento della filiera produttiva e regole del contratto

2019

In order to adopt a new perspective when discussing contract law in the digital age, the following essay analyses the general topic of the fragmentation of the production in the light of three case studies: Google Nest thermostat, crowd- funding and robo-advisors. The three cases are considered relevant for the matter due to the fact that they all exercises the same disrupting power on their supply chain: if, indeed, part of the products and services of their supply chain have been long offered by one or few providers, now the same products and services are real- ized by an indefinite number of players horizontally spread over the market. Do common constitutional traditions matter in the field of regulated markets?

2019

A new tension is spreading throughout Europe: the tension between Common Constitutional Traditions (CCTS) and Constitutional Identity (CI). Recent cases brought before the Court of Justice of the European Union (CJEU), which have gone to the core of European Integration, have revealed this tension. In particular, this tension was highlighted in the “Taricco saga” and in the more recent cases concerning the independence of the judiciary in Poland. The rulings concerning the first group of cases use the concept of CCTS in a quite conventional way, that is, with regard to fundamental rights. The essay examines the possibility that the complex relationship between the CCTS and CI will affect ot…

La regolazione indipendente del settore ferroviario

2019

The National Independent Authority for Transport, imposed by European Law and established in Italy in 2013, is characterized by using wide powers of control, regulation and sanction, which cover all transport sectors. Regulatory competences seem in particular to interfere, in some areas, with the functions, also of political direction, of the State, Regional and Local Government, as well as the competences of the other administrative independent bodies such as the National Antitrust Authority or National Anti-Corruption Authority. This requires the provision of forms of coordination and cooperation beetwen those authorities, waiting for a clear actio finium regundorum by the national legisl…

La speciale disciplina urbanistica ed edilizia delle opere pubbliche

2023

Public works constitute one of the main objects of ordinary urban planning and building regulations. However, since the 1970s, laws have been gradually introduced with the effect of derogating either from the provisions of the general land use plan or from the general discipline on authorization procedures to build. The decree-laws n. 77/2021 and n. 36/2022 have continued this trend with reference to projects necessary to achieve the strategic objectives of the European Union for the country's ecological and energy transition included in the National Recovery and Resilience Plan (PNRR) and the Integrated National Plan for Energy and Climate (PNIEC). This paper explains the causes of this su…
