The turbulence of images: On imagery, media and ethnographic discourse

1997

As the anthropological theory of politeness has put it, people have universally two kinds of social want. They wish to be close to others, liked and accepted, but they also want some distance, freedom from imposition and respect of mutual difference. These wants, which one may also call basic human rights, are however often violated, and images play an important role in this. Images are ultimately generated in the human mind and may find verbal as well as written and pictorial representation. Tyler [1978] has proposed a typology of mental images based on criteria of conscious control, completeness, abstraction, media and autonomy. These criteria also prove useful when probing into prototypi…

Youth perceptions of violence against women through a sexist chant in the football stadium: an exploratory analysis

2017

Gender-based violence and violence against women (VAW) refers to any violation of fundamental rights. However, some forms of VAW are viewed as unproblematic, acceptable and deserved. Taking into account that sexist chants in football stadiums reinforce VAW, the purpose of the study is to determine how a group of adolescents can normalize or challenge an example of sexist chants. Semi-structured qualitative interviews were conducted and the participants were asked to discuss to what extent the actions could be considered as gender-based violence. Most of the youth were highly unconscious of the sexist nature of the video and only a few recognized it as gender-based violence. Such awareness i…

“Narrative Museums” and Curators’ Rights: The Protection of a Museum Exhibition and Its Scenario under Polish Law

2020

Since at least the 1990s, museums have expanded to cover a variety of societal functions, often enabling inclusive and participatory spaces for critical dialogue about the past and the future, and bridging together various narratives and cultural experiences, contributing to social cohesion and reconciliation. The new functions of museums, involving novel technological forms of display and communication, pose several legal questions concerning the management of such institutions, their resources, and exhibitions, including issues of copyright and other intellectual property rights. While referring to a recent case concerning an alleged infringement of the moral rights of the authors of the …

Explaining the Electoral Failure of Extreme-Right Parties in Estonia and Latvia

2009

Extreme-right political parties have achieved significant electoral success in Europe in recent years. This paper considers why this electoral success has not been replicated in contemporary Estonia and Latvia. The paper begins with a discussion of the necessary background conditions for the success of extreme-right movements, finding that they do largely exist in Estonia and Latvia. The paper then moves on to map the rising levels of extreme-right mobilisation among both titular and Russian-speaking parts of the population. We examine two hypotheses to explain the electoral failure of extreme-right parties: (1) The institutional hypothesis argues that the party and electoral laws check ext…

“A Shameless Ideology of Shameless Women”: Positioning the Other in Social Media Discourse Surrounding a Women’s Rights Movement in Pakistan

2022

This study analyzes social media (YouTube) discourse related to Aurat March 2019, a women’s rights movement in Pakistan. Using a discourse analytical approach that draws on the premises of Positioning theory, the analysis reveals the following two major storylines from the data: “The women who stray from the path, and the men who will return them to it,” and “Islam under threat from the outside.” Social media platforms allow their users to express opinions in online spaces, often resulting in polarization and clustering of like-minded people in so-called echo-chambers. This study demonstrates how social media users actively participate in the discursive construction of the “other,” and how…

Defining “National Treasures” in the European Union. Is the Sky Really the Limit?

2019

The main objective of this article is to analyse the scope of EU Member States’ right to determine national treasures for the purpose of Directive 2014/60/EU on the return of cultural objects. While investigating the issue at the EU, human rights, and constitutional levels, the authors argue that the right to define what constitutes national treasures is not an absolute right. The definition of this particular category of cultural objects cannot be used to circumvent the rules on the free movement of goods and to hamper this freedom in an unjustifiable and arbitrary manner. On the human rights and constitutional levels, Member States’ right cannot interfere with the right to enjoy one’s pos…

Użycie słowa „czas” w Księdze Syracydesa

2020

2014

The purpose of this essay is to reframe the conceptual division between rights and remedies by identifying those issues that are generally raised in the legal discourse when dealing with the two perspectives. The focus will be particularly on: policies that govern rights and remedies, judicial discretion, and judicial interpretation. While the traditional account based on a sharp opposition of rights and remedies proved to be untrustworthy, the proposed conceptualization helps to outline the distinction in a more realistic way.
