A defense of the moral and legal right to secede
2021
We defend the moral and legal right to secede in accordance with plebiscitary theory. Our paper has three main goals. First, by offering a schematic characterization of plebiscitary theory, the main arguments in its favour (and the main objections to them), we contribute to clarify the structure of this complex debate. Second, we stress the point that, if the moral right to secede is established, the resistance for its inclusion into positive law is unjustified. Finally, by addressing old and new objections to plebiscitary theory, we hope to make a compelling case for a wider recognition of secessionist rights.
2021
We are back to discuss ownership. In fact, beyond all possible predictions, the history of property law is combined with that of fundamental human rights. The individual perspective of absoluteness, present in the codicistic tradition, the predominantly economic content of the property right, governed by the Constitution, are today deeply intertwined with the perspective of the protection and enhancement of the subject who owns it, in accordance with the provisions of the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) and the Charter of Fundamental Rights of the European Union (Charter of Nice). . This new perspective of protection is associated with …
ASSESSMENT OF LATVIAN PENSION SYSTEM IN THE CONTEXT OF EUROPEAN PILLAR OF SOCIAL RIGHTS
2021
Latvian pension system is considered to be one of the most sustainable, but it should be mentioned that financial sustainability may be achieved in different ways and sometimes the aspects of sustainability are estimated without considering system’s ability to provide equity, equality and adequacy of retirement provision. The European Pillar of Social Rights has been proclaimed in 2017. According to this statement delivering on the principles and rights defined under the Pillar is the joint responsibility of the EU institutions, member states, social partners and other stakeholders. The 3rd chapter devoted to social protection and inclusion establishes the key approaches to determining the …
2020
In this paper it is submitted that an assessment of the functioning of the European system of protection of human rights lead to different results, depending on whether one considers the entire life of this system or the last twenty years (par. 1). Such an assessment is beyond any doubt positive in the first case, insofar as both the action of the States parties (progressive "jurisdictionalisation" of the protection system; extension to eastern Europe, ecc.) and the case law of the European Court (evolutive interpretation, ecc.) are concerned (par. 2). Different considerations are developed with regard to the last twenty years, despite the stipulation of Protocol 14, 15 and 16, and despite …

Democratic Legitimacy and the Court of Justice of the European Union
2016
The chapter on democratic legitimacy and the Court of Justice of the European Union (CJEU) focuses on whether the CJEU through judicial activism may be claimed to have established its jurisprudence beyond the bounds of democratic legitimacy. Judicial activism has to a large extent been found in cases concerning the prerogatives of the CJEU, while in relation to other issues, such as the application of fundamental rights, the CJEU has demonstrated political awareness in its use of judicial activism, which however has diminished legal certainty. In general the CJEU has acted within the bounds of democratic legitimacy, but further clarification of its jurisprudence in controversial areas may b…
A new and controversial scenario in the gathering of evidence at the European level: The proposal for a directive on the European investigation order
2014
In April 2010 a group of EU Member States proposed a Directive on the European Investigation Order, an instrument which, if adopted, will significantly change the way in which evidence is gathered at the EU level. After the failure of the EEW, which focused on the exchange of evidence which had already been gathered, the objective of the new text is to create a single instrument for obtaining all kinds of evidence located in another Member State. The aim of this paper is to examine, within the current framework, the suitability of this new instrument, with particular reference to its impact on the rights of defendants.
Social constitutionalism and the sustainable development goals (sdg)
2021
