International Law, War and Human Rights: The Humanitarian Response
2013
One of the most important issues in the international political and legal system comprises the interaction between human rights and humanitarian law. In particular, the separate treatment of such areas of law allows to delineate different contents and application procedures, while the joint consideration is not simple, in view of the reasons for which each of the two has been created. Humanitarian law is a set of rules of conduct limited to a political and legal situation pathological, and presumably temporary. Against this regulatory system, the international law of human rights is the establishment of a political and legal concept of man as endowed with certain inalienable rights that con…

Women’s rights and gender equality during the COVID-19 pandemic
2021
This paper contributes to the existing literature by investigating the scope of States’ obligations to realise women’s rights and ensure gender equality amid the COVID-19 pandemic. To this end, the analysis focuses on three areas where the gendered consequences of emergency measures have been the most widespread and/or severe: the disproportionate impact of social distancing policies enacted to curb the spread of the virus on women’s right to work (Section 2); the increased rates of gender-based domestic violence triggered by stay-at-home mandates and other emergency measures restricting the movement of people (Section 3); and the uniquely adverse consequences of the diversion of health res…

Email: chiara.vitucci@unipa.it 1 Nollkaemper, ‘ The European Courts and the Security Council: Between Dedoublement Fonctionnel and Balancing of Values: A Reply to De Sena and Vitucci ’ , 20 EJIL (2009) 862. Andre Nollkaemper, Grainne de Burca and Iris Canor have made a number of critical observations which are – in part at least – interesting and useful. A full examination of them would probably demand more time and more space than we have been given here. Nevertheless, we will try to reply to some of their remarks and to clear up…
DNA Fingerprinting as a Tool of Paternity Testing in Germany
1991
Soon after the discovery of the ABO blood groups by Landsteiner their forensic application was suggested by Max Richter at the 74. Versammlung Deutscher Naturforscher und Arzte at Karlsbad (Karlovy Vary) in 1902 [1], Landsteiner’s Nobel lecture “Uber individuelle Unterschiede des menschlichen Blutes” in 1930 [2] provided a landmark on the path towards the discovery of so-called hypervariable minisatellite regions of human DNA by Alec Jeffreys in 1985 [3]. Since the individual patterns of any human being seemed to be unique it is well understood that this achievement was immediately welcomed with great enthusiasm by the scientific community and the public opinion. Soon thereafter, however, s…
