“Sicherungsverwahrung” (preventive detention) in Germany under the scrutiny of the ECHR

2020

The societal challenge how to deal with offenders deemed habitually dangerous, requires to balance needs for security of the general public with the human rights of the potential extreme dangerous offender. The prediction of future heavy crimes can never be precise. Hence, all measures infringing the rights of individuals deemed dangerous are very problematic from a human rights perspective. Germany uses “Sicherungsverwahrung” (preventive detention) to handle this challenge. The concept basically meant that after their prison-sentence, offenders deemed dangerous were kept in prison like conditions until they were not deemed dangerous anymore. The European Court of Human Rights (ECtHR) inter…

The Right to Health and Resource Allocation. Who Gets What and Why in the COVID-19 Pandemic

2020

Abstract The COVID-19 outbreak has led to a worldwide, substantial increase in the demand for pharmaceuticals, hospital beds, ventilators, and medical supplies. When needs suddenly exceed demand worldwide, resources may quickly become scarce in relation to potential demand, so that strict rationing is the only viable response. Against this backdrop, this paper scrutinizes the rationales for prioritization of scarce resources, and it questions the actual role and reach of the market with regard to resources that are essential to deliver health care, especially in times of severe shortage, such as during a global pandemic.

Darsi codici etici in antropologia.

2016

Through review of selected anthropological ethical codes an attempt is made to outline the fundamental ethical principles of anthropological research and their applicability to current practices of applied anthropology. The Statement on Problems of Anthropological Research and Ethics was adopted by the American Anthropological Association in response to the need to take distance from military research after the Camelot scandal. Anthropology reacted stronger than other disciplines due to its methodology implying a relation of trust with the community. The Codice etico of AISEA defines the anthropologist’s obligations with different type of actors. In applied anthropology more attention shoul…

Decisiones automatizadas: problemas y soluciones jurídicas. Más allá de la protección de datos

2021

The Winding Road to Accessing the Voices of One Thousand Schoolchildren : A Nexus Analysis of Collecting Data for a Survey

2021

This article describes a nexus analysis of the lengthy, complex process of negotiating access to schools for a research project surveying 1,002 children (aged 9–12 years) about their digital and language practices. The analysis distinguished layers of adult-centered gatekeeping, each of which needed to be tackled in sequence. Bottlenecks particularly arose at the gatekeeping stage, in which superintendents of schools decided whether to grant research access to schools. Factors facilitating the research process included the hybrid data collection design, the procedures for obtaining parental consent, and the active collaboration with the children themselves. A significant discourse emerged a…

The role of Intellectual Property Rights in the value capturing of crowdsourcing for innovation contests

2017

In this study, we investigate the role of IPR arrangements in crowdsourcing for innovation challenges. Integrating Property Rights Theory and the open innovation literature, we propose that specific challenge attributes affect the seekers organizations’ choice between alternative IPR arrangements and how this choice, in turn, affects the self-selection of external solvers into solving the challenge. We collected multi-source, interview data with open innovation directors and we built a unique data set of 729 awarded challenges broadcasted on InnoCentive platform from 2010 to 2016. Our findings contribute to the emerging literature on open innovation and crowdsourcing literature by bringing …

LAND AND PROPERTY RIGHTS WITHIN THE URBANISM LAW

2017

The study intends to highlight the functions of property rights in relation to the characteristics of urbanism law. The analyse aims to identify the role of public authorities in the production process of planning public policies, under current regulations in force in Romania. Moreover, while the legislation led to confer a social function of property rights, this conception of property rights comes up against the revival of private property, which is likely to complicate the implementation of public planning policies. The social function of the property law, however, could reach its limits in the coming years. Indeed, the jurisprudence appears to give a boost to the individualistic dimensi…
