Unlawful Aid and Public Undertakings: Vertical Direct Effect of Article 108(3), third sentence TFEU

This paper addresses the position of public undertakings that may appear in a State aid law-related context in their capacity of intermediaries or grantors of aid vis-à-vis Article 108(3), third sentence, TFEU, to check whether the standstill obligation directly applies to public undertakings where they act to grant or disburse State aid. Public undertakings must refrain from granting aid in breach of the standstill obligation, as addressees of the standstill obligation. Where a public undertaking fails to apply Article 108(3) TFEU, it opens itself to claims based on Union law, including claims for damages. Union law is stated as it stood on 20 June 2021.

We examined the diel vertical migrations of the macroscopic pelagic relict crustaceans Gammaracanthus lacustris, Mysis relicta, Monoporeia affinis and Pallaseopsis quadrispinosa in the deep Lake Paasivesi basin of the Saimaa lake complex. The samples were collected in October 2006 and 2007 using a Hydro-Bios Multi Plankton Sampler onboard the research vessel R/V Muikku. The study provides information about the day-and-night and year-to-year changes in the vertical distribution of these crustaceans. The Gulf of Sirte is a largely unexplored area in the southernmost Mediterranean Sea.We are presenting here 2008 summer data on the distribution pattern of living coccolithophores, a main phytoplankton calcifying group, in 105 samples from 20 stations. The survey includes coastal and offshore stations, enabling us to provide indications on the dynamics of phytoplankton productivity in relation to oceanographic processes. The total coccosphere concentrations show higher values in the offshore stations and lower ones for coastal sites.
