La corruzione privata e la riforma dell'art. 2635 c.c.

L'articolo esplora il trattamento penale dei fatti di corruzione privata, anche alla luce della recente legge n. 190/2012. Due le tesi principali sostenute: 1) contrariamente a quel che si crede, nel nostro ordinamento esiste già (ed esisteva anche prima del 2012) una incriminazione - sia pur non diretta - dei fatti di corruzione privata; 2) la riforma del 2012 cambia l'offensita' tipica dei reati di cui all'art. 2635 c.c., affiancando alla tutela del patrimonio, una tutela della concorrenza quale interesse dei consumatori. Nel contributo in oggetto l'autore, muovendo dalla decisione delle Sezioni Unite della Cassazione n. 61 del 7 gennaio 2014, coglie l'occasione per riesaminare le vecchie e nuove problematiche sottese all’intervento dei creditori nel processo esecutivo. It concludes however that a revolution like the aforesaid explained would be only apparently advantageouOld and new problems related to the intervention of creditors in the expropriation (marginal notes at Cass. Sez. Un. January 7 2014 n. 61) Moving from the decision of the Sezioni Unite n. 61/2014 the author takes the opportunity to re-examine old and new problems related to the intervention of creditors in the forceable execution. The first major theme concerns par condicio creditorum which is examined in its evolutionary history since the Code Napoleon through its period of maximum extension (the Code of 1940) until its reduction as a result of the reforms of 2005. The author examines the possibility to overcome quoad effectum the distinction between sine titulo et cum titulo interveners in light of jurisprudence’s evolution between 1978 2009 and 2014. The possibility in particular concerns those creditors sine titulo the where credit has not been contested (ex art. 499 c.p.c.) by the debtor seek payment and partecipate to distribution. In the last section the author examines the possibilities for other creditors to contest the intervention of the creditor sine titulo ex art. 499 c.p.c. (utendo iuribus in subrogation in case of inaction of the debtor) or in the distribution phase ex art. 512 c.p.c. He concludes that the only person that will be really damaged if he doesn’t contest - ex art. 499 c.p.c. - the credit it is precisely the debtor. Sella, A NEW NAME FOR THE GENUS Linaresia EL KADIRI, 1992 (NASSELLARIA, RADIOLARIA) PREOCCUPIED BY COPEPOD CRUSTACEANS (LAMIPPIDAE, MAXILLOPODA)

The aim of this short note is to create a new name of this genus since the original name Linaresia proved to pre-exist in the paleontological literature ( Linaresia de Zulueta, 1908, Family Lamippidae, Copepod crustaceans, and Linaresia Gonzalez-Donoso, 1968, Family Gavelinellidae, Agglutinated Foraminifera). The new name created for the above mentioned radiolarians is: Sella . This name derives from an arbitrary combination of letters (International Code of Zoological Nomenclature). The type species of Sella is S. beniderkoulensis by original designation (El Kadiri, 1992).

Analysis of thermal infrared data from the Digital Airborne Imaging Spectrometer

Thermal infrared data of the Digital Airborne Imaging Spectrometer (DAIS), whose channels 74-79 are in the 8-13 w m waveband region, were analysed with the aim of recovering land surface temperature (LST). DAIS images were acquired over an experimental site where field and laboratory emissivity measurements were performed, and these were used to recover the LST from the six DAIS thermal channels. Atmospheric correction of DAIS data was calculated by means of a nearby radiosounding and a radiative transfer model. Graphical interface for designing geometries and processing DICOM images for PENELOPE

One of he most difficult steps when preparing a Monte Carlo calculation is the design of their geometries. Such process is an error-prone, time-consuming, and complex step for any simulation in the field of medical physics. The software VoxelMages has been developed to help the user in this complex task. It allows to design arbitrary geometries and to process DICOM image files for simulations with the general-purpose Monte Carlo code PENELOPE. Its main characteristics are described in the following.

A Digital Watermarking Algorithm Based on Quantization of the DCT: Application on Medical Imaging

International audience; The objective of this paper is to elaborate a new watermarking algorithm applied to the medical imaging. This algorithm must be invisible, robust and has a rate, relatively high, integrating data. The proposed method uses the standard JPEG compression for the integration of medical data. The insertion block is inserted just after the quantization phase. To control identification and eventually the correction (if possible) of the inserted data, we use a series of turbocodes to recover the inserted data, after application of several attacks. The simulation studies are applied on MRI medicals images.

Then, we share our experience in designing and prototyping a HW/SW vision based smart embedded system as an ADAS that helps to increase the safety of car's drivers.
