Commissione di Garanzia e attuazione del diritto di sciopero nell'ordinamento costituzionale

La Costituzione repubblicana ha qualificato lo sciopero come diritto nella previsione dell'art. 40. La disposizione costituzionale mette in evidenza, pur nella sua estrema sintesi, l'idea che lo sciopero sia l'espressione di un conflitto, elemento caratterizzante i contesti pluralistici. Solo nel 1990, con la legge n. 146, il legislatore è intervenuto a disciplinare la materia, con una scelta che mantiene intatta l'eredità costituzionale, cioè quella del conflitto che richiede una composizione, e che individua nella Commissione di Garanzia il soggetto che deve provvedere alla composizione e al contemperamento degli interessi in conflitto.

Il saggio esamina il monumento funebre del prelato milanese Guidotto d’Abbiate che guidò l’arcidiocesi di Messina dal 1304 sino al 1333. L’Arcivescovo, che commissionò l’opera nel 1326 allo scultore senese Goro di Gregorio, si dedicò al progetto “di abbellimento” della Cattedrale della Città dello Stretto dove è custodito il monumento. A quest’ultimo manufatto potrebbe appartenere la Madonna con il Bambino, detta degli Storpi, ora custodita nel Museo Regionale Interdisciplinare di Messina. Does the European Commission (Commission) manage to transform and re-direct the roles played by Commission civil servants? To test the old neo-functionalist claim on loyalty transfer among civil servants, this article provides fresh survey and interview data on seconded national experts in the Commission. The transformative powers of the Commission are tested by assessing the extent to which seconded national experts adopt supranational role perceptions. Studies of executive institutions have largely dealt separately with national and international executive institutions (IEIs). This study unpacks and repacks four conflicting decision-making dynamics that unfolds at the frontier of IEIs – that is, at the institutional rim where national and international executive institutions meet, interact and collide. The empirical laboratory utilised is seconded national experts in the European Commission. The concept / institution of the Commissioner for Children ' 'Pare d'Òrfens' appears for the first time in Valencia with Law 12/2008 on Protection of Children and Adolescents. The purpose of this article is to inform readers of the existence of this concept / institution, analysing the regulatory development that has taken place and comparing its performance with other similar concepts/institutions existing in other Spanish regions, in order to critically assess the work done in recent years. To close the paper, we give a number of conclusions drawn after completing the research on this concept / institution, including several general recommendations in the form of constructive criticism.
