L'attribuzione della qualifica 'vir bonus' nella prassi giudiziaria d'età repubblicana (a proposito di Cato, or. frg. 186 Sbelnd. = 206 Malc.)

The qualification ‘vir bonus’, involved by an ancient judicial rule and by a sponsio (linked to this rule) containing the clause ‘ni vir melior esset’, which are both attested in a fragment of Cato the censor, expresses a positive assessment from a moral point of view and not from a social point of view, as is shown by all the sources we have for the III-II century BC. The emergence and the diffusion just in this period of a figure of vir bonus caracterised in a moral sense is probably due to a political and economic transformation of the Roman society.

On the basis of unpublished manuscript materials – especially a letter from 22nd April, 1866 – this paper reconstructs some unknown aspects of the background and of the evaluation of Wilhelm Studemund’s apograph of the Institutes of Gaius published in 1874 and its Supplementa published in 1884. Particular attention is paid to the use of chemical substances for the decipherment of the Gaius’ palimpsest.

The author analyzes the inspiring reasons of the adrogatio libertorum classical discipline. In particular, he criticizes the idea according to which the limitations by jurists derived from the need to save the iura patronatus; furthermore, because the adrogatio libertorum could not compromise the iura patronatus, the consent of the patron was not required to perfect the act.

The paper deals with Paul. 5 quaest., a well-known text on subject of innominate contracts. The author comes to the conclusion that the current version of the text is largely interpolated. At least for § 5, the concession of the contractual action must be attributed to Justinian’s compilers. Great caution is required for § 4, although the use of the agere praescriptis verbis is to be excluded for relationships involving a factum, quod locari non possit: for such relationships, the use of the the actio de dolo or actio in factum must be assumed, as appropriate.

The author deals with three unknown and mysterious Egyptian papyri (Pap. Lond. iii, 1164 h, BGU iv 1157, P. Oxy xvii 2136), which are dated from the i b.C. to the iii a.d. His idea is that these documents prove the use of the contract of misthoprasia for the fulfillment of the munera for the annona. He demonstrates that this papyri contain a sort of long-term agreement, used to optimize the liturgical public service.
