La configuración del derecho de asilo en la Unión Europea a la luz renovadora del derecho a no sufrir tortura o tratos inhumanos y degradantes

2018

The Chapter analyzes the EU Court of Justice case law on Aliens' Protection Regimes in light of the EU Charter of Fundamental Rights and of the European Convention of Human Rights focusing on: a) the impact of non refoulement and protection from risk of torture and inhuman or degrading treatments principles; b) procedural safeguards of right to seek "asylum" on the implementation of EU "Dublin regulation". Both aspects are taken into exam in the perspective of identifying common EU standards of protection of fundamental rights of the persons in the process of judicial implementation of the EU Charter of Fundamental Rights lead by the European Union Court of Justice (expecially after the ent…

The comments on Arts. 34-40 of EU Regulation 2015/848 deal with opening of secondary insolvency proceedings. These comments systematically tackle the prerequisites required for the opening of secondary insolvency proceedings, the relationship between main and secondary proceedings and the duties of cooperation that are put on the courts and the insolvency practitioners of both main and secondary proceedings. A particular attention is devoted to the introduction of the so-called “Undertaking to Avoid the Opening of Secondary Insolvency Proceedings” (Art. 36).

From ‘Prisoner's Dilemma’ to Reluctance to Use Judicial Discretion: The Enemies of Cooperation in European Cross-Border Cases

2017

The paper deals with cooperation in European cross-border cases. Two main ideas are put forward. The first idea is that cooperation requires a legal framework which is certain—otherwise, prescriptions imposing duties of cooperation and communication might produce ‘prisoner’s dilemmas’ and, paradoxically, an unwillingness to cooperate. The second idea is that prescriptions imposing duties of cooperation and communication have an intrinsic open texture—this characteristic ontologically requires courts and insolvency practitioners to make choices between different rulings and activities. These findings imply that, while interventions, both at European level and at national level, aiming at mak…

2020

(?contratti di soggiorno?) entered into prior to the outbreak of the Coronavirus pandemic, for services to be enjoyed during the emergency period. The work focuses, in particular, on the analysis of the emergency provisions introduced by the Italian legislator in favour of the tourism sector, by allowing professionals operating in the tourism sector to postpone the timing of the sojourn by issuing a voucher to be used in one year following the issuance date as an alternative to the reimbursement of any payment made prior to the emergency periods solutions in conformity with the principles of solidarity adopted in order to balance and sa…
