I respingimenti in mare di migranti alla luce della Convenzione europea dei diritti umani
2009
Forcible return of migrants and the European Convention on human rights - Italian authorities have recently undertaken a new policy to face migration flows from north african coasts. Since May, 6th 2009 Italian coastguard and financial police vessels have intercepted a large number of boats carrying migrants and returned them to Libya, in force of a readmission agreement between Italy and Libya. These operations, even if they take place on the high seas, have to comply with the European Convention for Human Rights, considering that the migrants fall under jurisdiction of Italian authorities within the meaning of art. 1 of the Convention. In particular, on the basis of the European Court of …

La revocabilità delle decisioni delle Commissioni di ricorso dell’EUIPO (tra continuità funzionale e funzione giustiziale)
2020
The Court clarifies the concept of ‘obvious procedural error’ for the purposes of the European Union trade mark regulation which should lead EUIPO to revoke its own decision. The EUIPO’s Board of Appeal’s decisions in inter partes proceedings are revocable under art. 80, para.1 of Regulation n.207/2009, in case of a clear procedural mistake committed by the above Boards of Appeal. Any infringement of the obligation to state reasons, such as a failure to state reasons or an inadequate statement of reasons, constitutes a procedural error for the purposes of art. 80 para. 1. The legal error of the Board does not invalidate the decision under appeal, if the decision’s is based on different lega…
Richiedere a un detenuto di fornire prova dell’avvenuta conversione viola la sua libertà di religione
2021
This short contribution provides a comment of the judgment of the European Court on Human Rights in the case of Neagu v. Romania (application no. 21969/15), in which the Court found a violation of Article 9 (right to freedom of thought, conscience and religion) of the European Convention on Human Rights. The case concerned a prisoner who had converted to Islam while in detention. He complained of the refusal of the Romanian authorities to provide him with pork-free meals, in accordance with the precepts of his religion, unless he furnished proof that he was an adherent of that religion. The Court found that, bearing in mind the provisions introduced by the order of the Ministry of Justice r…
