This contribution aims to shed light on the specific mechanism of migrant categorization implemented by the so-called «Hotspot approach», which was launched by the EU Agenda on Migration in May 2015. This approach is here envisaged as a response to the current changes in the composition of migration towards Europe. Provisions contained in EU and Italian policy documents are compared with concrete practices enacted on the ground by investigating two case studies: the initial opening of the Hotspot at Milo, in Trapani, and the first months of functioning of the Hotspot on Lampedusa. This paper discusses the binomial hybris and revolution. In particular, the question of whether the excessive dominants’ arrogance, who have too much both in material and symbolic terms, is sufficient to explain the deflagration of an insurgency and the interruption of a legal order. The question will be addressed by interweaving the reflections of authors who have discussed this topic with a material collected by the author through a legal-political ethnography conducted in Chile during the revolt that broke out in October 2019 and led to a new constituent phase. This chapter analyzes the philosophical implications related to the “position of vulnerability” defined by the Directive 2011/36/EU on Preventing and Combating Trafficking in Human Beings and Protecting its Victims as “a situation in which the person concerned has no real or acceptable alternative but to submit to the abuse involved” (art. 2.2). In particular, the chapter focuses on the “choice” made by migrant women employed in care and domestic work and in the agricultural sector in Italy. A partire dalla definizione teorica della vulnerabilità come posizione, il contributo prende in considerazione come paradigmatica le condizione che si producono per i minori migranti soli lungo il viaggio come durante la permanenza in Italia. Particolare attenzione viene dedicata alle procedure della richiesta di asilo come ambito di vittimizzazione secondaria, e all'ineffettività dei principi posti a tutela dei minori alla luce del nuovo corso della politica italiana.

In this paper I aim at pointing out some difficulties raised by the so-called thesis of the protective perimeter of liberties (ToPP), that is: the thesis according to which: neither a privilege necessarily involves a claim to non-interference, nor a claim to non-interference necessarily presupposes a privilege. As to the first aspect of the thesis, I argue that it relies on a misleading concept of ‘interference with a liberty’, which surfaces in the examples to which the thesis is made applicable.
