Settore IUS/17 - Diritto PenaleThe paper analyses the offence of unlawful work intermediation and exploitation offering a comparative analysis with the German punitive system. The study focuses in particular on the limits of legitimacy of criminal law in the punishment of gangmaster acts in the attempt to avoid that the punitive intervention in economic and contractual dynamics of a mutual nature could be so intrusive to be in contrast with the principle of subsidiarity. To this end the author suggests an interpretative perspective that centres the penal disvalue of the offence under article 603-bis of the criminal code on the harm to fundamental workers’ rights – as linked to articles 4 35 and 36 of the Italian Constitutions – which work as a limit to entrepreneurial freedom. To be sure the indexes of exploitation listed by the criminalising norm seem to echo those fundamental human rights attributed to a person as a worker: those very same rights that – when harmed in their minimal and therefore intangible dimension – legitimise the intervention of the ius terribile. The article also stresses the protection of the job market: in this sense the offence – even if situated within the Kernstrafrecht – represents a new paradigm of the institutional response within the framework of the contemporary relationships between law and economics.

Tambourines have been recorded until today by paintings archive documentation observations provided by foreign travellers folkloric literature and quite widely by modern ethnomusicology through audio and video recordings collected on the field. Morphology performance techniques repertoires decorations and social use of tambourines in Sicily refer to the wider context of Italian (central-southern part) and Mediteranean area but with some peculiarities chiefly referring to performance skills. Though similar to the techniques practised in other Italian regions in Sicily we can observe a typical style that can be connected with a common historical background with the Arabic-Islamic world.

Given an operator K∈B(H), in this paper the authors introduce K-fusion frames as a generalization of fusion frames, defined as a sequence {Wi} of closed subspaces of the Hilbert space H. For K=1, this becomes a fusion frame. They prove some properties of K-fusion frames, based on considering the operator K and the frame operators. In the last section, for a unitary system U, the authors define a K-fusion frame generator in a way similar to the frame vectors for unitary systems. Some properties and characterization theorems are derived for operators in the generalized local commutant of U.

Interpreting Connexive Principles in Coherence-Based Probability Logic

We present probabilistic approaches to check the validity of selected connexive principles within the setting of coherence. Connexive logics emerged from the intuition that conditionals of the form If \(\mathord {\thicksim }A\), then A, should not hold, since the conditional’s antecedent \(\mathord {\thicksim }A\) contradicts its consequent A. Our approach covers this intuition by observing that for an event A the only coherent probability assessment on the conditional event \(A|\bar{A}\) is \(p(A|\bar{A})=0\). Epidemiological dynamics of norovirus GII.4 variant New Orleans 2009.

Norovirus (NoV) is one of the major causes of diarrhoeal disease with epidemic, outbreak and sporadic patterns in humans of all ages worldwide. NoVs of genotype GII.4 cause nearly 80–90 % of all NoV infections in humans. Periodically, some GII.4 strains become predominant, generating major pandemic variants. Retrospective analysis of the GII.4 NoV strains detected in Italy between 2007 and 2013 indicated that the pandemic variant New Orleans 2009 emerged in Italy in the late 2009, became predominant in 2010–2011 and continued to circulate in a sporadic fashion until April 2013. SAMPLING DESIGN IN SHARE WAVE 7

This chapter documents the sampling design adopted in SHARE. Starting with a definition of the SHARE target population, we describe the protocol that is followed to harmonise and document the sampling procedure and present the sampling frames used by the countries that recruited a baseline or refreshment sample in Wave 7. We then discuss some important aspects of the SHARE sampling design, such as stratification, clustering, variation in selection probabilities and sample composition. Finally, we provide additional information about the sampling variables included in the released SHARE dataset.
