Royal Dutch Shell Plc

2021

The paper examines a UK-Supreme Court of Justice decision (Okbapi v. Royal Dutch Shell Plc) concerning the liability of a parent company for the abusive con-ducts of its subsidiaries. The Court explores whether and in what circumstances the UK-domiciled parent company of a multi-national group of companies may owe a common law duty of care to individuals who allegedly suffer serious harm as a re-sult of alleged systemic health, safety and environmental failings of one of its overseas subsidiaries as the operator of a joint venture operation. Although the decision focuses on preliminary issues of summary judgment, it pro-vides inputs to a renewed reflection on the duty of care upon the paren…

Contributions of Nonverbal Cues to the Accurate Judgment of Personality Traits

2020

This chapter summarizes research on nonverbal expressions of behavior (nonverbal cues) and how they contribute to the accuracy of personality judgments. First, it presents a conceptual overview of relevant nonverbal cues in the domains of facial expressions, body language, paralanguage, and appearance as well as approaches to assess these cues on different levels of aggregation. It then summarizes research on the validity of nonverbal cues (what kind of nonverbal cues are good indicators of personality?) and the utilization of nonverbal cues (what kind of nonverbal cues lead to personality impressions?), resulting in a catalog of those cues that drive judgment accuracy for different traits.…

Lens and Dual Lens Models

2019

This chapter presents variants of Brunswik’s lens model aimed to understand whether, when, and why trait judgments are more or less accurate. After outlining the basic concepts of lens models, it describes exemplary studies that have applied the lens model to unravel personality expression and impression formation processes that lead to more or less accurate judgments. Next, it gives an overview of factors that can influence the accuracy of trait judgments and explains these accuracy moderators within the lens model framework. It then describes an extension of the lens model, the dual lens model, that differentiates more controlled versus more automatic aspects on all levels of the lens mod…

Accentuating the Positive, Eliminating the Negative? Relationship Maintenance as a Predictor of Two-Dimensional Relationship Quality

2012

In this study, relationship maintenance and its connections with positive and negative relationship quality were examined among Finnish parents (N = 177 women and 153 men; i.e., partners from 150 couples and 27 women and 3 men whose partner did not participate in the study). Relationship maintenance was measured using Stafford, Dainton, and Haas's (2000) version of the RMSM and two-dimensional relationship quality using Fincham and Linfield's (1997) PANQIMS. Structural equation modeling was utilized to analyze paired data. Women were found to report more relationship maintenance behaviors than their partners. The results showed further that relationship maintenance was connected with both p…

Knowledge, opinions and attitudes of Italian mothers towards HPV vaccination and Pap test

2015

Aim This study evaluated the knowledge and attitudes of Italian mothers – whose daughters had been vaccinated in 2012 – towards primary (anti-HPV vaccination) and secondary (Pap test screening) cervical cancer prevention, as well as sources of information and mother-daughter communication on health issues. Methods The survey – part of a multicenter study carried out in 4 Italian cities (Ferrara, Rome, Cassino and Palermo) – was conducted through self-administered questionnaires. The first univariate analysis evaluated differences between mothers of under-18s and over-18s relative to knowledge and attitudes on HPV vaccination and Pap test. The second univariate analysis evaluated differences…

1998

The tympanum of the central portal of Nantes cathedral. Owing to a reassessment of the available sources on the sculptured decor of the façade of Saint-Pierre et Saint-Paul cathedral in Nantes, it is possible to bring some precisions about the original state of the building. The tympanum of the central portal of this façade did not present, as is usually acknowledged, an original openwork design which was filled up in the 17th century when the organ loft was erected. The analysis of the still existing remnants, as well as the size and nature of the stones used in this portal leads one to think that its present state dates back to the actual construction. Textual pieces of evidence allow the…

Unfair Terms, Protective Nullity and Court’s Powers: Certain Reference Points after Jőrös’ and Asbeek Brusse’s Rulings

2015

Review. The article examines the cases of Jőrös (Case C- 397/11,) and Asbeek Brusse,(case C‑488–11), both dated 30 may 2013, as a starting point for a more general analysis of the ECJ’s approach to the legal consequences to be drawn by the national Court from finding that a contractual term is unfair. The work focuses on the question of whether the interest of the consumer — at the basis of the remedy under consideration — is compatible with the general public interest and with the duty of the National Court to declare the nullity of its own motion, perhaps in contrast with the individual interest of the party. The paper criticizes the “Pannon ruling”, and points out how the more recent Ban…

Settore IUS/07 - Diritto Del LavoroThe essay analyzes recent measures to reduce the cost of labor in the public sector in the light of several judgments on the topic. The economic crisis is always present in the legal reasoning of the judges. The litigation rate increases and the judicial power must assess the legitimacy of the choices of public administration and the judicial reaction of public workers in an attempt to recover in whole or in part the remuneration quotas lost (or not adequate during the time).

2022

The paper intends to focus on the issue of the relationship between the judgment of constitutional legitimacy and the legislator's discretionary power in criminal matters. The Constitutional Court, especially in recent years, has carried out an overall rewriting of criminal law, through rulings that have affected some of the most significant institutions, introducing a substitute regulation for that deliberated by the legislator. To achieve this result, in the name of safeguarding fundamental rights, the Constitutional Court devised new techniques of adjudication, forcing patterns that had already been established in its jurisprudence or proposing new ways of adjudication in incidental proc…

2023

The article deals with the notion of personal freedom as it is regulated by art. 13 of Italian Constitution, drawing the main differences with other fundamental rights, in particular with the freedom of movement (art. 16 Cost.). To this end, the paper explores the main doctrinal orientations and the most recent constitutional case-law on the subject; specifically, it proposes a reading of the motivational points of the judgment n. 127 of 2022 of the Italian Constitutional Court which resolved some touchy issues of constitutionality that arose during the pandemic emergency. In conclusion, the text questions, with a look at the near future, on the usability of traditional tools for the protec…
