Confucianism has often been compared to natural law, mainly to its non-volunta- ristic currents. However, the possibility to include Confucianism in the group of natural law theories is problematic. Recently, a few scholars, and notably Peerenboom, have challenged the widely shared thesis that Confucius and early Confucian thinkers should be mentioned in the ranks of natural law philosophers. At the beginning of The Concept of Law Hart suggests a mistaken assimilation between conduct that is ‘non-optional’ and conduct that is ‘obligatory’ (i.e,. conduct that is either coerced or subject to an obligation). This suggested assimilation vitiates the argument of the whole book, leading Hart to neglect the different ways in which the law typically tracks, corroborates or constitutes power relations. In 2012, almost 4,500 people died in the United States while waiting for kidney transplants. In 2013, 4,100 died in the European Union while officially placed on waiting lists. To solve this problem, there are essentially two ethi-cally acceptable solutions; but both have, in their current state, disadvantages.
