The Italian legal clinics movement. Data and prospects
2015
It is not more than 5 years since legal clinics were founded in Italian Universities: a very recent history indeed and similar to that of other Western European countries. I will try to explain this through some data collected by an inquiry that I ran in order to have a more detailed map of this phenomena and to conjecture its future evolution. In the following paragraphs I will present the data inquiry and I will try to explain the process of establishing the Italian movement for legal education, its options and challenges. It is worth pointing out why I use the term “movement”. What is going on in Italy, and I think elsewhere, is not simply the proliferation of single clinics, but the eme…
Neil MacCormick's Second Thoughts on Legal Reasoning and Legal Theory. A Defence of the Original View
2011
This paper offers a diachronic reconstruction of MacCormick's theory of law and legal argumentation: In particular, two related points will be highlighted in which the difference between the perspective upheld in Legal Reasoning and Legal Theory and the later writings is particularly marked. The first point concerns MacCormick's gradual break with legal positivism, and more specifically the thesis that the implicit pretension to justice of law proves legal positivism false in all its different versions. The second point concerns MacCormick's acceptance of the one-right-answer thesis and the consequent thinning of the differences between MacCormick's theory of legal reasoning and that of Ron…
© 2020 University of Valencia, Human Rights Institute. Riarticolare la giustizia. L'impegno semiotico del Giorno della civetta
2020
The study uses tools of structural and interpretative semiotics to propose a close reading of the Day of the Owl…
Moral Neuroeducation, Ethics of Justice and Pluralism
2019
In order to design a model of moral neuroeducation for pluralistic and democratic societies three core issues need to be addressed in-depth: firstly, the cerebral basis of moral behaviour (neuroethics); secondly, how neuroscientific knowledge can be engaged in the teaching of moral education (moral neuroeducation); and finally, the specific ethical model underpinning this area of education (moral and political philosophy). The last of these three issues is the focus of this chapter, as it is fundamental to the whole project of moral neuroeducation, and it structures the approach to moral neuroeducation proposed in this chapter. Drawing on the conceptual framework of Adela Cortina’s ethics o…
Back to the Amitsur-Levitzki theorem: a super version for the orthosymplectic Lie superalgebra osp(1, 2n)
2003
We prove an Amitsur-Levitzki type theorem for the Lie superalgebras osp(1,2n) inspired by Kostant's cohomological interpretation of the classical theorem. We show that the Lie superalgebras gl(p,q) cannot satisfy an Amitsur-Levitzki type super identity if p, q are non zero and conjecture that neither can any other classical simple Lie superalgebra with the exception of osp(1,2n).
In France, Latin domus was known up to now only in the medieval Latin lexicon and the French life of st. Léger. Place names reveal its presence in many items and various morphological forms ; the narrative and normative sources allow to restore its semantic evolution. Keywords: domus; Moyen Âge; France; semantics;…
Court Interpreting 2009: an undervalued and misunderstood profession? Or: will justice speak?
2010
The article addresses a number of topical issues relating to court interpreting. After examining a number of issues discussed among US interpreters in July 2009, it considers the provision of court interpreting in a number of different English-speaking jurisdictions, including the position of agencies. It presents the cost of a lack of judicial awareness of the issues involved in providing competent interpreting in legal proceedings, and looks at how rare languages are dealt with in the United States. It examines best practice and how this can quickly turn into worst practice. It considers the situation in Canada’s Province of Ontario, where a class action has been brought against the Minis…
