Entrusting to the trade union the procedural instrument of guaranteeing the collective interests of workers cannot depend on the contractual form chosen by the parties to the relationship. Excluding, therefore, that the trade union has an interest in acting in the face of conduct that undermines the regularity of the collective protection action is contrary to the very raison d'être of Article 28 of the Labour Statute to defend the constitutionally relevant rights involved in industrial relations, as well as to the spirit of promotion and support of trade union action of the Workers' Statute.

The contribution examines the recent orientations of the Italian judges, according to which the provision of a forfeiture term, in order to obtain the recognition of some rights, complies with the Italian Constitution. This is provided that the norms that provide for a forfeiture term must be interpreted strictly, because widening their application should infringe the right of defense, acknowledged by article 24 of the Italian Constitution.
Vulnerability to Forced Labour and Trafficking: The case of Romanian women in the agricultural sector in Sicily

This paper focuses on labour and sexual exploitation faced by Romanian female workers employed in the agricultural sector in Ragusa, Sicily, Italy. Drawing on fieldwork conducted in 2013 and 2014 with Romanian female farm workers in Ragusa, the paper identifies factors that contribute towards their vulnerability to exploitation. By paying specific attention to the experiences of women who are mothers with dependent children, we look at structural factors that increase their vulnerability and consider how this vulnerability ‘forces’ women into situations whereby they effectively accept and/or submit to abuse. Disadvantages faced by parents adversely affect their children’s chances of success in the labour market. We study the influence of intergenerational transmission of parental socio-economic background on the educational attainment and occupational outcome of children, also considering gender differences. To tackle such a complex system of relationships across the outcome variables (both exogenous and endogenous), we adopt a path analysis model. In particular, we study the intergenerational transmission of disadvantage using the innovative and rich AD SILC database, which shows the evolution of occupational outcomes over eight years (measured by wages in 2011 and 2018).
