Compatibility of Latvian non-conviction-based confiscation with Convention on Human Rights

2022

Traditional “repressive” criminal law is no longer sufficient to deal with the new threats posed by the global risk and information society. New forms of combatting international organised crime, drug trafficking and other serious crimes have emerged to target the most crucial aspect of incitive of the criminals – their money. Deprivation of property illegally obtained is an essential tool for crimes and money laundering. It led to the question of whether it is by human rights to confiscate the proceeds of crime, detected merely, e.g., in the form of suspects’ unexplained wealth, under a concept of unjust enrichment and re-establishment of the situation before a crime, and to do so without …

The presumption of innocence in the EU competition law

2022

This Bachelor thesis aims to analyse the application of the presumption of innocence in the EU competition law, more precisely in the anti-cartel proceedings. In addition, this thesis will provide the analysis of the categorisation of the competition law. This, in turn, is a topical debate due to the fact that in competition law the penalties are comparable to criminal charges notwithstanding the administrative procedure. The thesis will try to answer the question “To what extent is the presumption of innocence applied in the EU anti-cartel procedure?”. This paper's primary objective is to identify the procedural rights of cartel members, analyse their implementation, and emphasise any pote…

Legal controversies and ethical considerations concerning the property rights in the human body

2021

When considering the rise of the biotech industry over the years, one might wonder if the procurement of the biological materials, that are necessary for the success of the industry, was done through ethical and safe measures, especially considering the stagnant position of many countries towards granting individuals ownership rights over their bodies. As such, this paper inspects and compares the current legal approaches that are used in certain common law and civil law jurisdictions to determine individuals’ rights over their bodies, and considers the bundle of rights concept and the law of equity as possible solutions to the ethical and equitable deficiencies observed in certain jurisdic…

Human rights in the emergency situation: constitutional perspective of Latvia

2022

The concept of an emergency situation can be considered a novelty in the international legal system that gained its overwhelming importance due to the spread of Covid-19 pandemics all over the globe. Was the international community ready to employ clear and well-structured mechanisms of emergency situation concept in the context of human rights protection? Was the Latvian legal response to the Covid-19 emergency in the field of human rights protection successful? The “institution of emergency” in the international area was developed by the ECHR, whose ideas were incorporated into Latvian constitutional system and legal order. El treball social davanta la crisis

2010

The economic crisis is a time when the social sector professional has to live up to expectations by informing, raising awareness, helping with self-organization and mobilisation from our privileged position as intermediaries with the people, honouring our ethical obligation to fight for the social rights of the underprivileged and defending them. One cannot understand a social worker still managing to remain faithful to their ethical principles while not participating in denunciation and campaigning groups and not having motives for getting involved in the denunciation protests and mobilizations taking place all over the land today.

On Defining the Participatory Museum: The Case of the Museum of the Second World War in Gdansk

2021

This article seeks to contribute to the current debate on the new definition of the “museum” – a debate which led to turmoil at the 2019 ICOM General Assembly in Kyoto. With reference to the case study of the Museum of the Second World War in Gdansk (MSWW), it analyses the new and very successful genre of the narrative museum, a genre which arguably fulfils the core elements of the definition currently being discussed by ICOM. In this regard, it brings into focus the paramount importance of community involvement in creating and managing narrative museums – an aspect that has been virtually absent in the academic and media debates over the nature of the MSWW and its programme. By pointing ou…

Powers and Fundamental Rights in Cyber Security

2015

Protection of privacy and confidential communications are crucial fundamental rights in cyber security. The protection of privacy and confidential communications are twofold in the meaning that active security steps in communications may require interference with confidential communications. The detection and profiling of potential threats may raise suspects on innocent participants of communications. The NCSC-FI inside the Communications Authority has the initial task and powers to monitor the cyber security. The bill for the Code of Information Society introduces new obligations for information security and preparation for emergency situations. If new powers will be granted to authorities…
