From needs to competencies : a case study on the integration of a rights based approach into NGO practises
2010
The objective of this qualitative case study is to provide knowledge on the possibilities of incorporating a rights based approach (RBA) into practises of non-governmental organisations (NGOs) in the context of development and children. The study is confined to examine the possibilities of RBA in realising children’s rights within the child sponsorship programme (CSP) of a Finnish NGO, Fida International (Fida), and the conceptualisation of the child in regard to different approaches. Policy Makers', NGO, and Healthcare Workers' Accounts of Migrants' and Refugees' Healthcare Access Across Europe : Human Rights and Citizenship Based…
2020
Freely available healthcare, universally accessible to the population of citizens, is a key ideal for European welfare systems. As labor migration of the twentieth century gave way to the globalized streams of the twenty-first century, new challenges to fulfilling these ideals have emerged. The principle of freedom of movement, together with large-scale forced migration have led to large scale movements of people, making new demands on European healthcare systems which had previously been largely focused on meeting sedentary local populations' needs. Drawing on interviews with service providers working for NGOs and public healthcare systems and with policy makers across 10 European countrie…
European protection of fundamental rights in environmental matters. Contribution to the study of the relationship between law and science
2019
The prevention and sanction aspects of the protection against the pollution is manifested in Europe by the combination and complementarity of two matters (environment and fundamental rights) and two legal orders (European Union and Council of Europe). They consist of the protection of the environment that a person can expect to obtain in the context of the protection of these rights. They allow the management of "new risks" and the assimilation of pollution to a violation of a fundamental right under conditions including scientific knowledge. Protection of fundamental rights in environmental matters raises the question of the place given to scientific demonstration in jurisdictional work an…
OGGETTIVAZIONE E STORICITÀ DEI BENI COMUNI
2017
The progress of the commons as main subject in social sciences and in public debate has caused a new focus on the genealogy of proprietorship and his ideology. Framing this ideology, for a long time individual proprietorship has been represented as opposite to discourses that justified collective resource management. However, looking at the past of juridical systems, it is possible to highlight several links between individual property rights and collective rights. In particular historical analysis reveals that the main conceptual tool for producing both individual and collective ownership consists in instituting the goods as «objects». Both individual ownership and common goods are the eff…
Children’s Right to Play and Its Implementation: A Comparative, International Perspective
2021
The child's right to play is specifically addressed in the framework of the Convention on the Rights of the Child. The international recognition of this right is the central theme of this study. Through a documentary analysis of the reports of the States Parties to the Convention and the Concluding Observations of the Committee on the Rights of the Child, the study assesses the recognition of this right. The entry into force of General Comment 17 on the right of the child to rest, recreation, play, recreational activities, cultural life and the arts (art. 31) in 2013 should have marked a turning point in policies on children in the States Parties, but this did not occur. Policies cannot be …
